MEETING OF THE COUNCIL OF MINISTERS of 27 February 2008

The Council of Ministers met on this Wednesday, February 27, 2008, in Meeting Room  of the Council of Ministers, at the Government Palace in Dili, and approved:


1 - National Policy on Education

The Council of Ministers approved in its meeting today, a resolution that Approves the National Policy on Education. The overall objective of the development policy is to provide a decisive contribution to the harmonious development of the country, through a system of education and training quality, which is able to meet the needs arising from social reality.
A system that contributes to the full and harmonious development of personality of the individual, encouraging the formation of free citizens, responsible, independent and solidarity and valuing the human dimension of work, open to dialogue and the free exchange of views. And that, together, form citizens able to judge with critical and creative the social environment in which they are involved and to engage in their creative transformation.

The policy document approved now includes the guiding principles of the Proposed Basic Law on Education which will soon be presented to the National Parliament.

2 - Decree-Law Approves the organic structure of  the Ministry of Economy and Development

This diploma adopted the Organic structure of the Ministry of Economy and Development, which defines the structure of the Ministry and the responsibilities and duties of each of its departments and agencies, in order to comply with the Constitution and the Decree-Law No. 7 / 2007 of September 5, which adopted the Organic Structure of IV Constitutional Government of the Democratic Republic of Timor-Leste.

The Ministry of Economy and Development includes an organisational structure based on the agencies and services that operate in the fields of economy, development of the sector of micro-finance and cooperatives, as well as the environment.

Small and medium enterprises, cooperatives, foreign direct investment in the country and the services of banking and insurance are  to be of the utmost important engines of development and job creation.

The Council of Ministers also reviewed and approved:

3 - Report of the Government on Providências and Measures Adopted in the Term of the Declaration of State of Emergency 11 to February 13, 2008

The Council of Ministers approved the report of the Government on Providências and Measures Adopted in the Term of the Declaration of the State of Emergency 11 to February 13, 2008, which will be forwarded to the National Parliament, in accordance with the provisions of paragraph 1 of Article 29. º of the Law n. 3 / 2008 of February 22 on the rule of Regime on the State of Emergency to that, as part of its supervisory powers, to appraise the implementation of their declaration.

457 petitioners are already in cantonment in Aitarak Laran - about 120 arrived today

About 120 petitioners arrived today at Aitarak Laran, adding to the 337 that were already in the cantonment area at the end of the day yesterday, and thus making a total of 457.

Aiming to survey the  needs, given the large number of petitioners who arrived in recent days, Aitarak Laran yesterday received a visit by the Deputy Minister of Health, the Secretary of State for Social Welfare and Natural Disasters, the Secretary of State Electricity, Water and Urban Affairs, and the Secretary of State for Public Works.

The Government has been making efforts to ensure that there are all the conditions necessary for the cantonment of the petitioners. Besides the distribution of food and electricity, today were made available another eight tents, mattresses for the newcomers, and containers of water were installed with a capacity of twenty thousand liters.

Petitioners come up in the districts of Ainaro, Bobonaro

In Ainaro, thirteen petitioners showed up today to UNPOL, which brought to Dili, informed Arcângelo Leite, Minister of State Administration, according to data provided by the administrator of the district. Throughout the national territory, the situation is normal and stable in terms of security, and the observance of the rule of site runs smoothly.

In the same district there was a fight between rival groups in the Lakelu suco in Hatubuilico, conflict that has been remedied with the assistance of the Task Force. The security forces also conducted an operation in Liurai suco, in the sub-district of Maubisse.

Also in the district of Ainaro several bridges and homes that threaten crumbling due to bad weather, a situation for which has already alerted the Ministry of Social Solidarity.

In Ermera started up military operations carried out by the actual ISF, the GNR and PNTL, informed the administrator of the district, which also indicated that  strong winds destroyed several plantations in Letefoho.

In Bobonaro, another group of petitioners handed to the police by focusing on local clinic and then accompanied by UNPOL to Dili.

In the village Builico, in the suco Balibo, sub-district of Balibo, seven homes were destroyed by strong gale that struck the region.

Minister for Social Solidarity evaluates results of the meeting of CPLP

From a univertotal se of 63612 internally displaced persons (IDPs), are already registered a total of 627 families who want to return to their homes, which corresponds to 5116 people, according to data from the Ministry of Social Solidarity.

The Secretary of State for Social Welfare and Natural Disasters today continued the work of coordination of the process of reintegration of fifty of these families in their districts of origin.

Maria Domingas Alves Fernandes, Minister of Social Solidarity, yesterday met today with the secretaries of state, directors, coordinators and with the Executive Secretariat of the CPLP to assess the results of the events that occurred in Dili recently technicians and ministers of Labor and Social Affairs those countries.

Continued today taking place in the CNRT in Dili, the "workshop" on tables of ex-Resistance, sponsored by the Secretary of State Affairs for veterans and Former Combatants.

Problem solved shortages of cement with assistance from the Government

The problem of shortage of cement has existed until a few days ago in East Timor is already solved as a result of efforts by the Prime Minister, Kay Rala Xanana Gusmao, and the Minister of Tourism, Trade and Industry, Gil Alves, along with importers, who responded positively to the call of the government.

Therefore, in the past day 24 were already unloaded 1,500 tonnes of cement, with guaranteed arrival of the other 1,800 tonnes on Friday and more 1,200 tonnes in the next day 3 March

The scarcity and high price in the market due to the adverse weather conditions, which had a negative impact on the processing of raw materials in factories. Moreover, the heavy rain and wind have hindered the arrival of shipping to East Timor. The rise in price of cement must be also to the increase in the barrel of oil on world markets.

Element of Reinado's group delivered to the police in Dili

One of the defendants of the case involving Alfredo Reinado prior to the events of the past day 11 February was handed over today to the police in Dili, the Attorney General of the Republic, Longuinhos Monteiro, reported.

Altogether 23 are the warrants issued, being three more in the process and taking other five were requested of the court, awaiting the order of the judge.

The government calls on the others to follow this good example of submitting to justice, and not choose the path of violence.

Secretary of State for Security regrets Incident with journalists of Timor Post

The Secretariat of State Security (SES) has already met with the journalists of Timor Post affected and presented apologies on behalf of the government for the incident today, in which the police used unjustified force, reiterating the need to correct this type of action.

The SES recalled that the police are under great pressure to have to work twenty four hours a day during the state of emergency. He appealed to citizens to cooperate further to a maximum, not violate the limitations imposed by the State of Emergency and provide the necessary assistance to the security forces to ensure that everything runs in the best way.

Government expressed gratitude for the Salutary behavior of the whole People

The Government reiterates its profound appreciation for the healthy behavior of the entire people so far, a support that must be maintained until the end of the state of emergency.

In an extraordinary meeting held on Saturday, the Council of Ministers expressed its full confidence in the Joint Command and all components of the Security Forces who are currently on the ground to assume responsibility for ensuring the results that the people and the state need to achieve during the State of emergency.

The Council of Ministers met in special session this Friday, February 23, 2008, in the Meeting Room  of the Council of Ministers, at the Government Palace in Dili, and approved:
 
1 - Resolution of the Government expressing its agreement with the structure of the Operational Command and the Joint Rules of Engagement for the Operational Forces.

The Council of Ministers decided to approve a resolution of the government expressing its agreement with the structure of the Operational Command and the Joint Rules of Engagement for the Operational Forces, approved by the Joint Command.

In the same diploma the Executive welcomes the Joint Command for the rapid and balanced manner with which created its structure and rules of engagement of forces. Is still full confidence in the Joint Command and all members of the Defence and Security Forces in the mission to ensure the stability and safeguard the democratic constitutional order.

As a result of the serious events of the day on February 11, 2008, which was put into question the democratic constitutional order, the government, who is to take the necessary steps to implement the rule of Site however decreed by the President of the Republic, adopted Resolution No 3 / 2008. The diploma determined the mobilization of the security and defence, to take out the operations necessary for the restoration of constitutional normalcy and order.

The resolution stipulated that up to the Head of State, Major General of the Armed Forces the formation of a joint command between the F-FDTL and PNTL, in the framework of their duties. The Joint Command has now knowledge of the constitution of the government structure of the Operational Command and the Joint Rules of Engagement Force Operational;

The Government deeply examined these two documents, which mirror a structure balanced between the two institutions, as part of an integrated intervention to cope with a situation very delicate and serious for the state, the organs of sovereignty and social peace of the population. And demonstrating a strong willingness on the part of the Joint establish clear rules and very strict for all involved in the pursuit of this mission.

The Government believes that these operational determinations, or with respect to the structure of command, whether in respect of forces rules of engagement , must be flexible in order to adapt itself should be permanently and therefore likely to change in according to the evolving circumstances.

2 - Decree of the Government that creates the Military Prison

The performance of the missions of the F-FDTL subject its members to the legality democratic force in East Timor. In this sense, beyond the general duties of conduct of all Timorese citizens, members of the F-FDTL are subject to special duties of the military condition.
 
In the prevention and repression of the completion of all the obligations incumbent on that the military Timorese it is important to ensure that his imprisonment not put at risk the safety and health of the military. It is therefore, the creation of appropriate conditions to ensure safety and respect for the fundamental rights of prisoners.
 
Accordingly, the Council of Ministers decided to review at its meeting today, the Decree of the Government approved at the meeting of last Wednesday, February 20, establishing the Military Prison, for the imprisonment of any of the military components of the armed forces at the time of the practice of the facts, and that dependence on the joint work of the members of the government responsible for the areas of Justice and Defence.

Research the attacks of February 11

No complaint against the police or military

According to information provided by the Attorney General of the Republic, Longuinhos Monteiro, until this moment, since the declaration of the state of the emergency there have been no complaints against the police or military submitted or registered in the office of the Prosecutor.

Longuinhos Monteiro recalled, in the wake of the attacks that have happened to the President and Prime Minister and the people who provided them security, on February 11, in order to carry out all investigation activities , the prosecutor delegated powers to UNPOL to investigate the facts relating to such attacks, given the mobility of them.

This is without the Attorney General of the Republic  disregarding the monitoring and supervision of procedural documents that UNPOL may not hold, particularly in cases of requests for warrants to search and arrest out of flagrante delicto.

According to the PGR, there were issued several warrants of notification to UNPOL for 20 people. In parallel, a Judge issued six warrants of arrest for the suspects.

They have also issued warrants for search and seizure of the homes of people listed as suspected, aiming at seizing objects that have a connection to the events on 11 February.

As part of joint operations between the F-FDTL and PNTL to fulfill the mission to capture the rebels involved in attacks on February 11 against the life of the President and Prime Minister, the deployment of troops was a priority.

The first days also served to outline the plan of action to create the operational structure and prepare the logistical support and health.

However, due to torrential rain that occurred during the night and morning,  a river overflowed its normal course, causing the landslides and destroying several homes in Liquiça.

Thirty-seven families were seriously affected by floods. Today twenty houses were identified as destroyed by torrential rains and now covered by water of the river, displaced more than one hundred families.

The Ministry of Social Solidarity has already sent to Liquiça hundred pads, fifty pots, 2500 cans of sardines, fifty bags of rice with 35 kg each, 1200 packages of juice Frutamin and 250 packets of biscuits.

In a coordinated work between the ministries of Infrastructure and Social Solidarity, was also sent to Liquiça heavy equipment of construction.

On the state of health of President Jose Ramos-Horta, doctors from the Royal Darwin Hospital reported that continues its gradual recovery. Yesterday, by agreeing, directed a few words to family members who accompany you. The President continues to rest, and the rest essential to accelerate its recovery.

The Council of Ministers, meeting today extraordinarily, decided to ask the President of the Republic interim extension of the state of emergency for an additional period of thirty days.

MEETING OF THE COUNCIL OF MINISTERS OF EXTRAORDINARY 21 February 2008

The Council of Ministers met, extraordinarily, this Thursday, February 21, 2008, in the Meeting Room  of the Council of Ministers, at the Government Palace in Dili, and decided:

To request to His Excellency the President to extend the state of emergency currently in force.

Despite the situation of peace that the country has experienced in recent days, it can not be forgetten that the elements of the group who strove seriously against democratic constitutional order of Timor-Leste, is still on the loose and unpunished.

Timor-Leste says it is constitutionally a Democratic State of Law, which is governed by the  rule of law and where justice reigns.

The continued freedom of this criminal group prolongs a situation of very serious threat to the organs of sovereignty and the general population that can not and must not continue.

The government, through the military and police authorities and supported by the judicial authorities have been conducting operations in search of the elements of this group and their accomplices, that these operations should be maintained even for a while so this threat can be totally resolved.

Therefore, the government, who is to implement the measures imposed in the Declaration of a State of Emergency decided to ask His Excellency the President of the Republic, in legal terms, to declare the extension of the state of Emergency.

EXTRAORDINARY MEETING OF THE COUNCIL OF MINISTERS OF 17 FEBRUARY 2008

The Council of Ministers met in special session this Sunday, February 17, 2008, in the Meeting  Room of the Council of Ministers, at the Government Palace in Dili, and adopted a resolution to instruct the Chief-of-Staff General of the Armed Forces to create a joint command, integrating the PNTL and F-FDTL, in order to implement the operations of security arising from the declaration of a state of emergency.

According to the resolution adopted by the Council of Ministers, the joint command will determine the operational intervention and coordination of PNTL and F-FDTL, in the context of their specific tasks, pursuant to Articles of conjugated d) of paragraph 2 of Article. 2 of Decree-Law No. 15/2006 and Article. 2 of Decree-Law No. 8 / 2004.

The Council of Ministers met on this Wednesday, February 13, 2008, in the Meeting Room of the Council of Ministers, at the Government Palace in Dili, and approved:

1 - Amendment to the Government's Organic Decree-Law
The Council of Ministers at its meeting today, approved a decree-law which equates, on a transitional basis until they are regulated their status, the senior of the Armed Forces and the National Police of Timor-Leste as members of the government, for effects remuneration.

2 - Decree Law approving the scheme for the Evaluation of Employees of Public Administration

The Council of Ministers also adopted a Decree Law of the Government approving the system of evaluation of the employees of the public administration, to ensure more fairness in access and advancement of careers of officials.

The evaluation of performance is an important tool for the introduction of a new culture of public administration, for a correct assessment of the resources allocated to each of the agencies and functions and the creation of conditions for greater motivation training, qualification and training of resources human.

MEETING OF THE COUNCIL OF MINISTERS OF 07 FEBRUARY 2008

The Council of Ministers meeting this Thursday, 07 February, 2008, in Room Meeting of the Council of Ministers, at the Government Palace in Dili, approved the following qualifications:

1 - Resolution appointing the members of the Superior Council of Judicial Magistrates This resolution is to approve the appointment of Dr. Dionísio Babo Soares da Costa and Dr.Cirilo José Jacob Valadares Cristóvão for the year, respectively, the functions of the member and alternate member of the Superior Council of Judicial Magistrates (CSMJ).

2 - Proposed Amendment Act that the Statute of the Civil Service
This Proposed Law to be submitted to the National Parliament seeks to adjust and clarify the matters provided for in the Statute of the Civil Service, approved by Law No. 8 / 2004 of June 16, and also submit measures towards professionalisation of the Civil Service with the aim of improving its efficiency and capacity to meet the needs of the population.

In addition to these benefits for the Civil Service, the First Amendment to the Status of Public Function will also make a positive impact through better definition of agents of the State by requiring a diploma and establishing a system of  probationary periods,  nominations to the Service Commission, the weekly hours of work and disciplinary issues.

The proposal also includes legislative authorisation for the government to establish and define the jurisdiction of the Civil Service Commission, as set out in the Programme of the Government.

3 - Amendment of Government Decree for extraordinary and other allowances to be paid to members of PNTL and F-FDTL

This Government Decree seeks to create supplementalremuneration to compensate for the particularly aadverse condition and greater efforts in the functions carried out by elements of the PNTL and F-FDTL.

The reform and restructuring of the Defence and Security forces is one of the priorities of the IV Constitutional Government, as an important step towards that the dignity of career military and police, through a compensation plan that takes into account the special working conditions of soldiers and police officers.
