MEETING OF THE COUNCIL OF MINISTERS of 26 MARCH 2008
The Council of Ministers met on this Wednesday, March 26, 2008, in the Meeting Room of the Council of Ministers, at the Government Palace in Dili, and approved:
1 - Proposed Basic Law on Education
The Constitution of the Republic commits the State to ensure availability of qualified teachers with the proper training and other human resources, in addition to the infrastructure and financial resources needed to ensure a quality education.
This law, which the Council of Ministers approved in its meeting today and will soon be sent to the National Parliament, establishes the general framework of the education system, its scope and its objectives. The educational system is the set of organized means of a formal or informal nature , which are expressed as freedom, the rights and duties fundamental personal education and concreteness of the right to education.
2 - Decree-Law that the Approves Pensions of Combatants of Martyrs and the National Liberation
The Status of Combatants of National Liberation (Law No. 3 / 2006 of 12 April) was a historic step towards the recognition of the contribution of those who fought for liberation of the homeland, as enshrined in Article 11. Constitution of the Democratic Republic East Timor, reserving the fighters of the national liberation, along with the obligation to comply duties implied the statute, a number of rights, including financial and social benefits.
This law regulates the different types of pension provided for in the Statute of Combatants of National Liberation, identifying the criteria for their allocation, values and procedure for processing the application.
3 - Resolution on the rights, honors and benefits of the ex-President of the Republic Francisco Xavier do Amaral
Under Article 11. Constitution of the Republic, which values the contribution of those who fought for national independence, and in agreement with the National Parliament resolution No. 10/2007 of 25 July, recognised the status of Ex-President of the Republic, the government decided to give the illustrious Mr Francisco Xavier do Amaral a number of advantages inherent in that status.
The Council of Ministers also examined:
4 - Proposed Law on Weapons
This law aims to criminalise conduct which could create danger to the life and physical integrity of citizens arising from the use and carrying of firearms, weapons white, weapons of pitch, weapons aimed at projecting toxic, corrosive or suffocating, substances or explosives devices or fireworks, and criminalizes trafficking of such weapons.
By legally defining the various types of weapons transport or whose detention is likely to be the subject of criminality, the draft law seeks to provide resources so the police can act appropriately to situations of violation of public order.
The Council of Ministers reviewed a draft law and suggested some changes, so the diploma will be presented in next meeting.

The Council of Ministers met on this Wednesday, March 19, 2008, in Room Meeting of the Council of Ministers, at the Government Palace in Dili, and approved:
1 - Decree that Approves the Organic Law of the Secretary of Promotion of Equality
The Council of Ministers at its meeting today, approved a decree-law which establishes the structure of the Secretary of Promotion of Equality. The Secretary of State gives a simple organizational structure, but endowed with services whose action is directed to the promotion of gender equality.
When you create a structure that supports the actions of strengthening the introduction of a gender perspective in the design, analysis, implementation and monitoring of policies of the Government, together with other measures to be carried out with civil society and national and international organisations, it contributes to minimise the gap between man and woman.
2 - Approves Resolution that the Constitution of Focal Points for the Gender Issues
The Council of Ministers at its meeting today, approved by resolution the establishment of focal points for the issues of gender. With this measure is implemented a mechanism that will operate in each of the ministries and departments of state dependent on the Prime Minister, and their regional offices to ensure the integration of the gender perspective for the development of strategies, policies and legislation of the Government, by carrying out analyses incidents in kind.
This mechanism works through officials of the government departments involved, designated for the purpose, which are assigned roles in this area.
The focal points for gender are the Interministerial Working Group will identify the opportunities and challenges for the implementation of the integrated approach to gender in the operation of the government of Timor-Leste and develop partnerships between ministries and departments of State and other key players.
3 - Proposed Law on Protection of Witnesses
This proposal, which the Council of Ministers approved in its meeting today, seeks to regulate the implementation of measures for the protection of witnesses in civil and criminal proceedings where their life, their physical or mental, their freedom or their assets of value considerably high posts are in danger because of their contribution to the proof of facts that are the subject of the proceeding.
Solutions Proposed regulations enshrined in law, and respect the reality of specific socio-cultural community Timorese, welcome contributions from various legal operators operating in East Timor and lessons learned from comparative law.
4 - Resolution on the Comprehensive Reform of the Telecommunications Sector.
The IV Constitutional Government intends to outline a new telecommunications policy based on improving the efficiency and scope of the national telecommunications regulator (ARCOM) and the assessment of the concession contract with the Timor Telecom, considering the monopoly of telecommunications and the benefits of competition.
At the meeting today, the Council of Ministers adopted a resolution which provides for a possible renegotiation of the concession contract with the Timor Telecom, in order to remove the rights of granting exclusive and put the company under conditions of free competition with new companies wishing to enter on the market.
The Government intends to implement a comprehensive reform of the telecommunications sector, encompassing:
• The development and implementation of a new policy on telecommunications for East Timor;
• A new legal framework regulator of the telecommunications sector;
• Strengthening the ability and authority of ARCOM as independent regulator of the sector;
• Establish an Action Group, to be appointed jointly by order of the ministers of finance and Infrastructure, to implement, within a maximum period of six months, the activities envisaged in this resolution; this group represent the government in the negotiation process with the Timor Telecom.

Special Meeting of the Council of Ministers of 18 March 2008
The government decided in the extraordinary meeting of the Council of Ministers held this Tuesday, March 18, 2008, to propose to the President of the Republic an interim extension of the state of emergency, for a period of thirty days.
The proposal of the government is to keep the state of emergency in force across the national territory from 00:00 the next day on March 23 and end at 24:00 on April 22, with the following limitations to the rights, freedoms and guarantees of citizens:
Restriction of the right to free movement, curfew between 23:00 and 5:00 a.m., safeguarding the rights laid down in points c) and f) of paragraph 1 of Article 3. º of the Law No. 3/2208, February 22;
The rights of expression and assembly, safeguarding the rights laid down in points d), e) and f) of paragraph 1 of Article 3. º of the Law No. 3 / 2208, to February 22;
The right to inviolability of the home, allowing the execution of home searches at night, provided that the competent judicial mandate has issued, and respecting the envisaged in point b) of paragraph 1 of Article 3. º of the Law n. 3/2008 of 22 February.
The proposal to present to the President of the Republic of the interim government also notes that the F-FDTL should instruct the support to civil authorities, through the Joint Command has formed, running the specific mission of coordinating and conducting operational intervention aimed at the detention of suspects of the crimes committed on 11 February and taking the necessary measures to restore the democratic normality. And stresses that the F-FDTL and PNTL, involved in ongoing operations, should scrupulously observe the legal precepts contained in Law No. 3 / 2008 of 22 February cited in the Decree-Law No. 2 / 2007, , March 8, on Operations of Criminal Prevention, Decree Law No 4 / 2006 of March 1 on schemes in Special Cases of Terrorism, Violent or Highly organized Crime.
It is recalled that the Declaration of State of Emergency, ordered on 11 February last, in the wake of the attacks against the President and Prime Minister, ran from the need to ensure the constitutional order and public peace and security that was violently called into question and preserve the rule of democratic law. The state of emergency decreed several times has managed to contain the seriousness of the threats to the stability of the country, ensure public order, reducing its strength and confining them to areas identified.
However, although reduced, localized, these threats do not vanish yet, continuing to escape a group of heavily armed men with equipment of war, apparently headed by former spokesperson of the petitioners Salsinha, suspected of involvement in attacks against security of the state and two of the holders of the organs of sovereignty.
The capture and submission to Justice of this armed group continues to be an imperative for the maintenance of public peace, but for that we need more time, and even some patience in order to avoid unnecessary bloodshed, never forgetting that it is essential that this threat is finally eliminated so that the country could again move along the path of development.

The Council of Ministers met on this Wednesday, March 12, 2008, in Room Meeting of the Council of Ministers, at the Government Palace in Dili, and approved:
1 - Decree approving the Organic Law of the Ministry of Justice.
This law establishes the Organizational Structure of the Ministry of Justice, which defines the powers, organization and functioning of their departments and agencies under its tutelage. The Ministry of Justice is the body responsible for the design, implementation and coordination of policy defined and approved by the National Parliament and the Council of Ministers for Justice and the areas of the law.
This proposed law aims to debureaucratise the organisational structure of the Ministry of Justice, through the creation of integrated services in direct and indirect of the state, such as National Directorates, on the one hand, and the Center for Legal Training and the Public Defender, on the other.
2 - Resolution of the Government granting a subsidy to families of the petitioners.
The Council of Ministers adopted a resolution aimed at the Government allocated a grant in the amount of USD 150 (one hundred fifty American dollars) to the families of each of the petitioners focused on Aitarak Laran, to ensure their livelihood immediately. This allowance is justified by the fact that the petitioners are almost all concentrated at the request of the government, some of which even left their jobs for that reason, and are thus unable to provide the sustenance of their families. The Ministry of Social Solidarity, through the Secretary of State for Social Welfare and Natural Disasters, in coordination with the Office for Civil Society of the Prime Minister, promote the necessary assistance to the distribution of monetary support.
The Council of Ministers also examined:
3 - Decentralization Program of Public Administration.
The Council of Ministers discussed and approved the guidelines of the process of decentralization and local government in East Timor, in order to prepare a Proposed Law to be submitted to the National Parliament in order to create a structure of municipalities to replace the current system of districts and subdistricts.
The program examined at the meeting today is based on a comprehensive dialogue that was conducted by the Interministerial Working Technical Studies for Decentralization group, with the participation of representatives of civil society and NGOs, who participated in the discussion held on extended visits to the districts , subdistricts and sucos, and is accompanied by a strategic framework and timetable for implementation.
4 - Presentation on Restructuring Wage Careers in the Civil Service.
The Council heard a presentation made by a technician of the Ministry of Finance concerning the restructuring wages and careers for the Civil Service. The government discussed the presentation, asked some questions and decided to deepen the study on the proposal made in later meeting.
5 - Presentation on amending budget.
The Finance Minister made a presentation to the Council of Ministers on Amending Budget to report on the steps and collaboration to by each member of the government.
6 - Presentation on "Task Force" in the Telecommunications Sector.
The Council heard a presentation of a proposal by the Ministry of Finance to change the legal order in force in the telecommunications sector. After an analysis and a thorough discussion on the matter, the Council of Ministers decided that it has to be deepened at a subsequent meeting.

The Council of Ministers met on this Wednesday, 05 March, 2008, in Room Meeting of the Council of Ministers, at the Government Palace in Dili, and approved:
1 - Approves Resolution that the National Policy for the Management of Disaster Risks
The management of disaster risks is critical to the socio-economic development of the country The IV Constitutional Government takes this responsibility very seriously and down in this document, which defines the National Policy for the Management of Disaster Risks of their objectives and key strategies for the sector in the next five years.
The Ministry of Social Solidarity, through the State Secretary for Social Welfare and Natural Disasters, set the main task of developing a system for disaster prevention, integrated and flexible, able to respond to the reality of East Timor, and looking include all citizens and foreign players as in the case of disasters.
2 - Decree that regulates the Provision of Services for Mobile Phone
The government has devoted great attention to the issue of telecommunications, particularly through the development of several projects, which have already begun to give, in a very visible, their fruit.
Among them, it is the mobile telecommunications services, which are assumidamente a success story in East Timor.
Does the government that the regulatory framework should evolve to enable better implementation of all goals, and it resolves to introduce new rules for operators of mobile phones, so they are protected and re-balance the values and interests to protect.
The present law regulating the contracts of adhesion, acceptance and use of SIM cards, mobile phone service. The provisions of this Act shall apply to contracts of adhesion to SIM cards issued by any entity concessionaire services of the mobile network. It heard the CTM, in accordance with paragraph 3 of the clause. 12 of the Concession Agreement of the Office of Telecommunications.
3 - Decree-Law Approves that the regime of monitoring of the fishing vessels
This Decree-Law establishes and governs the system of continuous monitoring of fishing vessels, satellite, called SIMOCEP. The aim is to monitor domestic and foreign fishing vessels licensed in East Timor, for the purpose of monitoring and supervision of the exercise of fisheries.
The aim is to improve the management of fisheries resources of Timor-Leste, through monitoring, control and effective monitoring of fishing vessels, improve law enforcement, especially in combating illegal fishing, unreported and unregulated; collect data and information on the activities of vessels to improve the sustainable management of national marine resources, and comply with the national and international obligations of the country on the practice of responsible fishing.
4 - Decree-Law Approves the organic that the Ministry of Tourism, Trade and Industry
Program IV of the Constitution provides for a government policy on development of tourism activities, commercial and industrial, as a mechanism of capital importance in poverty reduction and the fight against unemployment, clearly contributing to the social and political stability of the country.
Decree-Law No. 7 / 2007 of September 5, 2007, establishing the structure of the Organic IV Constitutional Government of the Democratic Republic of Timor-Leste, stipulates, in Article 37. °, the development or amendment of organic laws of Ministries.
This Decree-Law establishes the structure of organs and services that make up the Ministry of Tourism, Trade and Industry, giving them the necessary skills to the pursuit of policies of the government for these areas, in accordance with paragraph 2 of Article 29 of the said Code.
5 - Presentation of the Rules and Procedures for the Review of the General State Budget of 2008
The Council of Ministers at its meeting today, also adopted Rules and Procedures for the Review of the State General Budget 2008, which were presented in detail in the House by the Minister of Finance.
6 - Presentation on Policy and Rules for Use of Vehicles of the State
Technicians of the Ministry of Finance submitted a proposal for a new policy of allocating cars of the State and at the same time, set the new rules of use of such vehicles. The proposal was approved by the Council of Ministers.
7 - Presentation of National Priorities 2008
The Council heard a presentation made by the Minister of Finance identifying the priority targets and the results that the Government is committed to achieve by the end of 2008. She will subsequently carried out additional consultations with the various ministries, before this study to be presented at the meeting with the partners for the development of East Timor.
The document presented in plenary identifies six areas: public safety, social protection and solidarity; youth, employment and generation of income, improving the effectiveness of social services, and governance transparent and efficient.

Salsinha gathers men and says he is ready to deliver up - 641 petitioners in Aitarak Laran
The former lieutenant of the F-FDTL Salsinha announced today, through Father Adriano, parish priest of Ermera, he is prepared to surrender to the authorities in the next few hours, along with his men, who were dispersed and that he now tries to group.
In this sense, Salsinha asked the Joint Command, composed of elements of the F-FDTL and PNTL, to suspend operations arising in the area of Ermera.
Yesterday surrendered to the security forces Sunday Amaral "Kede", a factor which belonged to the group of former major Alfredo Reinado and that took part in the attack on the residence of the President. He brought a gun allegedly used in that attack.
Similarly, arrived today to the cantonment area of the Aitarak Laran in Dili, plus seven petitioners from Ermera, bringing to 641 the number of men in cantonment.
